FEEDY — Personalized Baby & Toddler Nutrition App

BY USING THE FEEDY MOBILE APPLICATION ("APP"), WEBSITE ("WEBSITE"), OR ANY SERVICES PROVIDED BY FEEDY ("SERVICES"), YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS OF USE ("TERMS"). IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE APP, WEBSITE, OR SERVICES.

1. IMPORTANT MEDICAL DISCLAIMER

THE APP DOES NOT PROVIDE MEDICAL ADVICE.

Feedy is not a medical provider, healthcare professional, dietitian, nutritionist, or allergist. The content, recipes, meal suggestions, nutritional information, AI-generated recommendations, articles, and any other information provided through the App (collectively, "Content") are for general informational and educational purposes only and are not intended as, and shall not be construed as, medical advice, diagnosis, or treatment.

AI-Generated Content: Feedy uses artificial intelligence to generate recipes and provide recommendations based on user-inputted dietary preferences, allergies, and nutritional goals. AI-generated content may contain errors, inaccuracies, or omissions. AI recommendations are not reviewed by medical professionals before being displayed to you. You must independently verify all information, especially regarding food allergies, intolerances, and dietary restrictions.

Allergy and Dietary Warnings: While Feedy allows you to input your child's allergies, dietary restrictions (e.g., pork-free, iron-rich diets), and other preferences, the App does not guarantee that generated recipes or suggestions will be free from allergens or suitable for your child's specific medical needs. Cross-contamination, ingredient substitutions, mislabeled products, and other factors beyond Feedy's control may result in exposure to allergens or unsuitable ingredients.

You acknowledge and agree that:

You are solely responsible for your child's health, safety, and well-being.
You will always consult with your child's pediatrician, allergist, dietitian, or other qualified healthcare provider before introducing new foods, following any dietary plan, or relying on any information provided by the App.
Feedy is not responsible or liable for any allergic reaction, adverse health event, injury, illness, or death resulting from the use of recipes, meal plans, AI chat recommendations, articles, or any other Content provided through the App.
You will not use the App as a substitute for professional medical advice, diagnosis, or treatment.
If your child has known food allergies, intolerances, or any medical condition affecting diet, you must verify all ingredients and recipes with a qualified healthcare provider before use.
If you believe your child is experiencing an allergic reaction or medical emergency, you should call emergency services (e.g., 999, 112, 911) immediately and not rely on the App for guidance.

FEEDY EXPRESSLY DISCLAIMS ALL LIABILITY FOR ANY HARM, INJURY, ALLERGIC REACTION, OR ADVERSE OUTCOME ARISING FROM YOUR USE OF THE APP OR RELIANCE ON ANY CONTENT PROVIDED THEREIN.

2. AI Chat Feature Disclaimer

Feedy includes an AI-powered chat feature ("AI Chat") that allows users to ask questions related to child nutrition, feeding, and related topics. You acknowledge and agree that:

AI Chat responses are generated by artificial intelligence and are not reviewed, approved, or endorsed by medical professionals, pediatricians, dietitians, or any other healthcare providers.
AI Chat may produce inaccurate, incomplete, outdated, or misleading information.
AI Chat is not a substitute for professional medical consultation. Never delay seeking or disregard professional medical advice because of something the AI Chat has told you.
Feedy does not guarantee the accuracy, reliability, completeness, or timeliness of any AI Chat response.
You use AI Chat at your own risk and Feedy shall not be liable for any decisions you make or actions you take based on AI Chat responses.

3. Articles, Educational Content, and Informational Resources

The App may provide articles, guides, tips, and other educational materials related to child nutrition, feeding milestones, baby-led weaning, dietary approaches, and general parenting topics ("Articles"). You acknowledge and agree that:

All Articles are for general informational and recommendation purposes only. They do not constitute medical, nutritional, dietetic, or any other professional advice.
Articles may be written by the Feedy team, generated or assisted by artificial intelligence, or sourced from third-party contributors. Regardless of authorship, no Article is a substitute for individualized advice from a qualified healthcare provider.
The information in Articles may not be applicable to your child's specific health conditions, developmental stage, allergies, or dietary needs.
Feedy does not guarantee the accuracy, completeness, currency, or applicability of any Article.
You are solely responsible for evaluating the suitability of any information found in Articles before applying it to your child.
Feedy is not liable for any harm, injury, allergic reaction, or adverse outcome arising from your reliance on any Article.

All Content in the App — including but not limited to recipes, AI-generated recommendations, AI Chat responses, Articles, Nutrition Tracker data, meal plans, and any other information — is strictly recommendatory in nature. The ultimate responsibility for all decisions regarding your child's nutrition, health, and safety rests entirely with you, the parent or legal guardian.

4. Eligibility and Account Registration

To use the App, you must be at least 18 years of age (or the age of majority in your jurisdiction). By creating an account, you represent and warrant that:

You are at least 18 years old.
All registration information you provide is accurate, current, and complete.
You will maintain the accuracy of such information.
You are responsible for maintaining the confidentiality of your account credentials.
You are responsible for all activities that occur under your account.
You will notify Feedy immediately of any unauthorized use of your account.

Feedy reserves the right to suspend or terminate your account at any time, for any reason, including but not limited to violation of these Terms.

5. Subscription and Payments

5.1 Subscription Plans

Feedy may offer free and paid subscription plans. Paid features may include, but are not limited to, premium recipes, advanced meal planning, enhanced AI Chat capabilities, and ad-free experience.

5.2 Billing and Renewal

Subscriptions are billed on a recurring basis (monthly or annually, as selected by you) through the Apple App Store, Google Play Store, or other applicable platform ("Platform").
Your subscription will automatically renew at the end of each billing period unless you cancel it at least 24 hours before the end of the current period.
Payment will be charged to your Platform account upon confirmation of purchase.

5.3 Cancellation

You may cancel your subscription at any time through your Platform's account settings.
Cancellation takes effect at the end of the current billing period. You will retain access to paid features until then.
Feedy does not provide refunds for partial billing periods.

5.4 Price Changes

Feedy reserves the right to change subscription prices at any time. Any price change will take effect at the start of the next billing period following the notice of the price change. Your continued use of the paid subscription after the price change constitutes your agreement to pay the new price.

5.5 Refunds

All purchases are subject to the refund policies of the applicable Platform (Apple App Store or Google Play Store). Feedy itself does not process refunds directly.

6. User-Generated Content

6.1 Your Content

The App may allow you to submit, post, or share recipes, photos, comments, reviews, and other content ("User Content"). By submitting User Content, you:

Grant Feedy a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display your User Content in connection with the App and Services, including for promotional purposes.
Represent and warrant that you own or have the necessary rights to submit the User Content and that it does not infringe any third party's intellectual property or other rights.
Acknowledge that you are solely responsible for your User Content, including its accuracy, legality, and safety.

6.2 Recipe Accuracy

If you submit a recipe, you are solely responsible for ensuring the accuracy of all ingredients, quantities, preparation instructions, and allergy warnings. Feedy is not responsible for verifying user-submitted recipes and shall not be liable for any harm resulting from inaccurate or misleading User Content.

6.3 Prohibited Content

You agree not to submit User Content that:

Is false, misleading, defamatory, obscene, abusive, or offensive.
Infringes any intellectual property rights, privacy rights, or other rights of third parties.
Contains medical claims or advice not supported by qualified professional guidance.
Promotes dangerous feeding practices or unsafe foods for children.
Contains viruses, malware, or other harmful code.
Violates any applicable law or regulation.

6.4 Content Moderation

Feedy reserves the right, but is not obligated, to review, edit, or remove any User Content at its sole discretion, without notice, for any reason.

7. Intellectual Property

All Content provided by Feedy (excluding User Content), including but not limited to text, graphics, logos, icons, images, recipes, articles, software, AI-generated content, and the design, selection, and arrangement thereof, is the exclusive property of Feedy or its licensors and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the App and its Content for personal, non-commercial purposes only. You may not:

Copy, reproduce, distribute, or publicly display any Content without Feedy's prior written consent.
Modify, create derivative works from, reverse engineer, or decompile any part of the App.
Use any data mining, scraping, or automated methods to access the App or its Content.
Use the App's Content to train, develop, or improve any artificial intelligence or machine learning model.

8. Nutrition Tracker

The App includes a nutrition tracking feature ("Nutrition Tracker") that allows you to log your child's meals and track nutritional intake. You acknowledge and agree that:

The Nutrition Tracker provides estimates only and may not accurately reflect actual nutritional values.
Nutritional data is based on general food databases and may not account for variations in ingredients, preparation methods, portion sizes, or brands.
The Nutrition Tracker is not a medical tool and should not be used to manage any medical condition, allergy, or dietary requirement without the guidance of a qualified healthcare provider.
Feedy is not liable for any health outcomes resulting from reliance on Nutrition Tracker data.

10. Assumption of Risk and Parental Responsibility

You expressly acknowledge and agree that your use of the App is entirely at your own risk.

As a parent or legal guardian, you bear full and sole responsibility for:

All decisions regarding your child's diet, nutrition, and food introduction.
Verifying the safety and suitability of any recipe, ingredient, meal plan, or recommendation provided by the App — whether generated by AI, submitted by other users, or published in Articles — before feeding it to your child.
Monitoring your child for allergic reactions or adverse effects when introducing any new food.
Consulting with qualified healthcare professionals regarding your child's specific dietary and medical needs.
Ensuring that all information you provide to the App (including allergies, dietary restrictions, and health conditions) is accurate, complete, and up to date.

Feedy acts solely as a technology platform that provides tools and informational content. Feedy does not act as a healthcare provider, does not make medical decisions, and does not assume any parental or caregiving responsibility. The relationship between you and Feedy is that of a technology service provider and user — not a doctor-patient, dietitian-client, or any other professional-client relationship.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

FEEDY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- YOUR USE OF OR INABILITY TO USE THE APP OR SERVICES;
- ANY ALLERGIC REACTION, ILLNESS, INJURY, OR ADVERSE HEALTH EVENT RESULTING FROM RECIPES, MEAL PLANS, AI RECOMMENDATIONS, OR ANY CONTENT PROVIDED THROUGH THE APP;
- ANY ERRORS, INACCURACIES, OR OMISSIONS IN AI-GENERATED CONTENT;
- UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA;
- ANY THIRD-PARTY CONDUCT ON THE APP;
- ANY OTHER MATTER RELATED TO THE APP OR SERVICES.
FEEDY'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO FEEDY IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR £50 (FIFTY POUNDS STERLING), WHICHEVER IS GREATER.
NOTHING IN THESE TERMS SHALL EXCLUDE OR LIMIT LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, FRAUD, OR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

12. Disclaimer of Warranties

THE APP AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

FEEDY DOES NOT WARRANT THAT:

The App will be uninterrupted, error-free, or secure.
The Content, including AI-generated recipes and recommendations, will be accurate, complete, reliable, or suitable for your child's needs.
Any defects will be corrected.
The App is free of viruses or other harmful components.

13. Indemnification

You agree to indemnify, defend, and hold harmless Feedy, its officers, directors, employees, agents, affiliates, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to:

Your use of the App or Services.
Your User Content.
Your violation of these Terms.
Your violation of any applicable law or regulation.
Any claim that your use of the App caused harm to your child or any third party.

14. Third-Party Links and Services

The App may contain links to third-party websites, products, or services. Feedy does not endorse, control, or assume responsibility for any third-party content, products, or services. Your interactions with third parties are solely between you and the third party.

15. Modifications to the App and Terms

15.1 App Changes

Feedy reserves the right to modify, suspend, or discontinue the App or any feature thereof at any time, with or without notice, and without liability to you.

15.2 Terms Changes

Feedy may update these Terms from time to time. The updated Terms will be posted within the App or on the Website with a revised "Last Updated" date. Your continued use of the App after any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App.

16. Termination

Feedy may terminate or suspend your access to the App at any time, with or without cause, with or without notice. Upon termination:

Your license to use the App is immediately revoked.
You must cease all use of the App.
Feedy may delete your account and associated data, subject to applicable data retention laws.
Sections that by their nature should survive termination (including but not limited to Sections 1, 6.1, 8, 10, 11, 12, 13, and 17) shall survive.

17. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within thirty (30) days, it shall be submitted to the exclusive jurisdiction of the courts of England and Wales.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

19. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Feedy regarding the use of the App and supersede all prior agreements and understandings.
